ACCEPTANCE OF GENERAL TERMS

User’s confirmation of order on the website http://www.bordeaux-wine-guindeuil.co.uk (by clicking on « confirm order » button) implies complete acceptance of the whole general terms and conditions. The contract will be ruled by French Law. Only Vignobles Guindeuil headquarters’ courts (Bordeaux) are competent.

ORDERING
Information provided by the customer when ordering engage its responsibility: in case of error in the delivery information given by customer, Vignobles Guindeuil could not be held responsible of the impossibility to deliver the product. Orders are definitive only when confirmed by customer’s payment. All offers depend on availability, without commitment and before sales. Considering the rare and speculative characteristics of some products, restrictions on available quantities can be implemented. In this case, available quantity is subjected to a limitation per household (same name, address, e-mail address, same bank account or card holder). Vignobles Guindeuil therefore reserves the right to refuse an order in case of doubts over a previous order of the same product. Vignobles Guindeuil offers are intended for individuals and in no case to professional retailers. Vignobles Guindeuil reserves the right to refuse its offers benefits to any customer that would turn out to be a professional. 

DELIVERY AND RECEIPT
Wines are delivered in wooden or cardboard boxes of 6 to 12 bottles, deliverable in one go at one place. Vignobles Guindeuil commits to do everything possible to deliver the products as fast as possible. The average period is about 3 weeks, as specified, and can vary according to the destination country chose by the customer. Delivery is made within the time limit by direct delivery of product to the customer, or in case of absence, by a notice of availability. Potential delays do not give customer the right to cancel order, refuse products or claim damages. The cases of force majeure that release the seller from its obligation of delivery are the following: war, riots, fire, strike, accidents or impossibility to get supplies. The products always travel at the recipient’s own risks. Please check your parcel when delivered. A 48-hours period is available for customers to express potential reservations in case of missing or deterioration.

WITHDRAWAL PERIOD
In accordance with the Consumption Law, the buyer have at his disposal a 7-clear-day period from the delivery to return products to seller, to exchange or repayment, payment penalty, with the exception of return fees.

PRICE
Price is stated in Euro. The price indicated on product descriptions does not include transport. The price indicated on the order confirmation by Vignobles Guindeuil is definitive, including all taxes and 20%-VAT for France. This price includes products price, and handling, packaging and transport costs. Prices indicated include all taxes (all taxes incl., except typographic mistake), in Mainland France (Including Corsica) (20% VAT) not including transport.

PAYMENT
Payment of orders can be made by cheque or debit card. Wines are still property of Vignobles Guindeuil until complete payment of bill.

LITIGATION
Complaints or protests will always be received with attentive kindness, honesty being always presumed with the one who take the trouble to expose his situations. In case of litigation, customer would address in priority to the company, to come to an amicable agreement. Failing that, the Commercial Court of Bordeaux is the only competent, whatever the accepted delivery place and payment mode.

LEGAL INFORMATION
Minors: In accordance to the statutory instrument n°59-107 from January 7th 1959 and the law n°74-631 from July 5th 1974, selling alcohol to minors under 16 years of age is forbidden. By ordering Wine at Vignobles Guindeuil users swear and affirm to be at least 16 years old at the date of the order. Alcohol abuse:  Alcohol abuse can damage your health. Users are invited to drink and appreciate it responsibly. Data protection: in accordance to the law 78-17 from January 6th 1978, the right of access and correction to user’s personal data is guarantee.
